Illinois: State Chamber Official Confident Malpractice Legislation Will be Upheld if Challenged in Courts

An Illinois Chamber of Commerce official says it is likely that the medical malpractice legislation that passed both houses of the Illinois legislature will be challenged in the courts.

Senate Bill 475, which passed May 30, limits awards for noneconomic damages, such as pain and suffering, in lawsuits at $500,000 for doctors and $1 million for hospitals.

But Rob Carney, director of legislative relations for the state chamber office, says he is confident the law would be upheld by the state Supreme Court.
