Low-speed Vehicles

Defines low speed electric vehicle; amends the definition of motor vehicle to include a low speed electric vehicle and the definition of motorcycle to exclude vehicles that are 3 wheeled and meet all the requirements of a low speed electric vehicle; allows the use of low speed electric vehicles on highways with a certain posted speed limit; requires low speed electric vehicles operated on a highway to be insured, titled and registered as a motor vehicle. Effective date: January 1, 2010.

Teen Drivers

Relates to motor vehicle operator's licenses; exempts 17-year olds who have enlisted in the military from the requirement to obtain an intermediate license; requires proof of enlistment; conforms and clarifies that individuals over the age of 18 are exempt from graduated driver's licensing provisions. Effective date: June 24, 2009.

All-terrain Vehicles

Requires the titling of all-terrain vehicles to be administered through the automated motor vehicle and titling registration system; establishes guidelines for promulgation of regulations; ensures the capability of receiving and discharging of liens; requires any state resident who purchases a new all-terrain vehicle or creates a security interest in an all-terrain vehicle after a specified date to apply for certificate of title; prohibits operating on road without certification. Effective date: July 1, 2010.

Salvage Vehicle

Excludes the cost of airbags from the calculation of damages that determine whether a vehicle meets the damaged threshold to be classified as a salvage vehicle; relates to the cost of parts and labor to reinstall a deployed airbag system; requires disclosures to be in writing. Effective date: October 1, 2009.

Workers’ Compensation

Relates to adoption of the sixth edition of the American Medical Association's Guides to the Evaluation of Permanent Impairment, published by the American Medical Association; provides for a study. Effective date: March 24, 2009.

Property Deductible

Allows an insurer to waive a deductible in whole or in part for an insured who experiences food spoilage as the result of a natural disaster in a county declared to be a federal disaster area. Effective date: March 20, 2009.
