Commercial Vehicles

Amends the Vehicles Code. Provides for commercial driver's license qualification standards. Provides for a waiver of certain testing requirements for an applicant who is a member of the armed forces or a veteran who had a position in the armed forces that required operation of a commercial motor vehicle, and has operated a vehicle similar to the vehicle the driver expects to operate. Effective date: January 25, 2009.

Chop Shop Act

Amends the Motor Vehicle Chop Shop and Illegally Obtained and Altered Property Act of 1998. Defines a chop shop as any building, lot or other premises where one or more persons engage in altering, destroying, disassembling, dismantling, reassembling, storing or possessing any motor vehicle or motor vehicle part known to be illegally obtained by theft, fraud or conspiracy to defraud. Effective date: December 10, 2008.

State Regulation

Amends the Insurance Company Act. Provides for investment by life insurance subsidiaries, in casualty insurance, for autism spectrum disorders coverage and colorectal cancer screening coverage. Provides in insurance holding companies for mergers with domestic insurers and for insurer standards. Creates the Insurance Restructuring Restricted Receipt Account. Provides for community health reinvestment by a hospital plan corporation. Relates to health maintenance organizations. Effective date: Varies.

Financial Regulation

Amends the Insurance Department Act of 1921. Defines company action level events for risk-based capital reporting requirements. Provides that if a property or casualty insurer has a company action event if the total adjusted capital greater is than or equal to its company action level RBC but less than the product of its authorized control level RBC and 3.0 and a trend test result that triggers regulatory attention, as determined in accordance with the Trend Test Calculation. Effective date: September 2, 2008.

Property Insurance

Regulates the amount of property insurance coverage required by certain lenders who secure the loan by a mortgage given by the borrower on real property or by placing a lien against real property. Provides that no lender may require a borrower, as a condition of obtaining or maintaining a secured loan, to obtain property insurance coverage which exceeds the replacement value of buildings and structures on the land used to secure the loan. Effective date: July 4, 1008.

Dangerous Dogs

Amends the Dog Act of 1982. Provides for issuance of dog licenses, requirements for kennels, out-of-State dealer license, bills of sale, health certificates for importation, inspections of premises and dogs, seizure and detention of dogs, selling, bartering or trading dogs, the Canine Health Board, dog bites and dangerous dogs, damages caused by coyotes. Makes editorial changes. Effective date: Varies.

Workers' Compensation

Amends the Pennsylvania Occupational Disease Act. Provides for greater additional compensatory benefits payable for disability or death resulting from work related silicosis, anthraco-silicosis, coal worker's pneumoconiosis, or asbestosis. Effective date: July 1, 2009.

Diesel Vehicles

Enacts the Diesel- Powered Motor Vehicle Idling Act. Imposes restriction on the length of time for which a diesel motor vehicle of a specified size which is engaged in commerce may be allowed to idle. Exempts motor homes and certain animal husbandry and agricultural vehicles. Provides additional exemptions for emergency vehicles, school buses, solid waste collection vehicles and vehicles performing certain tasks or undergoing certain inspections. Effective date: February 8, 2009.

Workers' Compensation

Makes appropriations from the Workmen's Compensation Administration Fund to the Department of Labor and Industry and the Department of Community and Economic Development to provide for the expenses of administering the Workers' Compensation Act, The Pennsylvania Occupational Disease Act and the Office of Small Business Advocate for the FY July 1, 2008, to June 30, 2009, and for the payment of bills incurred and remaining unpaid at the close of the FY 2008. Effective date: July 1, 2008.
