Fire Safety

Creates the Fire and Life Safety Device Act. Prohibits the manufacture, installation or sale of any device that appears to be a smoke detector, sprinkler head, carbon monoxide alarm, heat detector or device used for life safety or fire protection that is neither designed nor capable of performing such function. Provides individuals licensed under the Professional Engineering Practice Act may inspect life safety and fire protection devices. Exempts sworn law enforcement officers in criminal investigations. Effective date: June 1, 2009.

Fire Sprinkler Systems

Amends the Fire Protection District Act. Provides that the board of trustees of any fire protection district may establish a program to award grants to the owners of single family residential properties located within the fire protection district who install and maintain approved sprinkler or other fire suppression systems. Effective date: August 12, 2008.

Traffic Offense

Provides a person who enters a railroad grade crossing and obstructs passage of other vehicles, pedestrians, a train or railroad equipment shall have his or her driver's license suspended in addition to imposition of a mandatory fine and community service. Relates to the owner of any vehicle alleged to have violated the highway rail grade crossing or crosswalk restrictions at the time of violation. Effective date: January 1, 2009.

Property Insurance

Provides that in each municipality or fire protection district which has a fire department established and maintained by municipal or district ordinances, every corporation, company, and association which is not incorporated under state law and which is engaged in effecting fire insurance, shall pay to the municipality or district for the maintenance, use, and benefit of the fire department, a percentage of the gross receipts received from fire insurance upon property in the municipality or district. Effective date: August 12, 2008.

Vehicle Searches

Provides that a towing service may cause the vehicle registration records of the State to be searched by the Secretary of State when ownership information is needed for the towing service to give notification as required under the Code, provides that the towing service also shall give notice to all lienholders of record within the time period required for other notices. Relates to impounded vehicles and searches for stolen vehicle information. Effective date: August 15, 2008.

Salvage Vehicles

Provides out-of-state salvage vehicle buyers do not have to be licensed or issued an out-of-state salvage vehicle buyer's identification card. Provides that only salvage vehicle buyers licensed in another State may buy property at the auction. Provides an insurer making payment of damages on a total loss claim for the theft of a vehicle shall not be required to apply for a salvage certificate under certain circumstances. Regulates used vehicle dealers. Effective date: January 1, 2009.

Traffic Accidents

Relates to reporting of automobile accidents resulting in bodily injury, death, or property damage in excess of a specified amount if any of the vehicles is not covered by a liability insurance policy. Requires deposit of security sufficient to satisfy any judgment for damages not to exceed a specified amount. Requires notice of the security deposit to persons who sustained real or property damage in the accident. Provides authority to decrease the amount of security. Effective date: January 1, 2009.

Relates to driving under the influence, reckless homicide and vehicles equipped with ignition interlock devices. Relates to school bus drivers. Relates to persons not covered by an insurance policy. Provides for restitution in specified cases. Effective date: January 1, 2009.

Prohibits clear glass and plastic license plate covers. Effective date: June 1, 2008.

Teen Drivers

Relates to making a driver's license invalid for the operation of a motor vehicle during certain hours if the licensee is less than 18 years of age. Adds an exception for a person participating as an assigned driver in a Safe Rides program sponsored by the Boy Scouts of America or another national public service organization. Requires liability insurance that covers the program. Effective date: July 22, 2008.

Inoperable Vehicle

Provides that the definition of inoperable vehicle includes any motor vehicle that does not have a current license plate or current license tags attached to it if current license plates or license tags are otherwise required under the Vehicle Code. Provides that the provisions apply to a home rule county with a specified population. Effective date: August 26, 2008.

School Buses

Requires a driver of a school bus to open the service door and driver's window before crossing a railroad track or tracks. Effective date: January 1, 2009.

Monitoring Device

Amends fees for the issuance of a monitoring device driving permit or duplicate. Provides that an offender who opts out of having an MDDP issued may, during the drug or alcohol-related summary suspension of driving privileges, petition the court for an order for a MDDP. Provides that the fee paid by the offender when an MDDP is issued shall be deposited into the Monitoring Device Driving Permit Administration Fee Fund. Relates to a conviction for drunk driving involving death. Effective date: January 1, 2009.

Traffic Research

Amends the Vehicle Code. Provides that the Department of Transportation may furnish copies of its written accident reports to local agencies that are engaged in highway safety research and studies. Requires the report to be for the confidential use of the Department and the Secretary of State; amends provisions regarding vehicles operating under a certificate of convenience and necessity issued by the Commerce Commission; relates to disclosure of the insurance carrier. Effective date: July 25, 2008.

Restricted Driver's License

Provides that a person issued a restricted driving permit may transport children living in the person's household to and from daycare. Includes transportation to a medical facility Provides that a person issued a restricted driving permit conditioned on the use of an ignition interlock device must pay a monthly fee to the Secretary of State DUI Administration Fund. Includes persons required to use such device because of a second or subsequent DUI. Effective date: January 1, 2009.
