Effective date: July 26, 2009.

Expands the scope of business continuity plans for domestic insurers; requires each domestic insurer to create and maintain a written business continuity plan identifying procedures relating to a local, state, or national emergency or significant business disruption. Grants the insurance commissioner certain authority when the governor declares a state of emergency; authorizes the insurance commissioner to, when the governor declares a state of emergency, issue an order that addresses related matters related to insurance policies, including reporting requirements for claims, grace periods for payment of insurance premiums, and performance of other duties by insureds. Effective date: July 26, 2009.

Producer Licensing

Regulates persons selling, soliciting, or negotiating insurance; revises provisions of existing law relating to insurance producer licensure, a title insurance agent's licensure, or an insurance adjuster's licensure; adds provisions to existing law relating to the licensure of surplus line brokers. Flood Insurance

Requires the disclosure of information on flood insurance coverage; requires every insurer to provide written notice at policy issuance and annually thereafter to homeowner, condominium unit owner, residential tenant, and residential fire insurance policyholders that clearly and conspicuously discloses that the policy does not cover damage caused by flooding. Effective date: July 26, 2009.

Carbon Monoxide Detectors

Requires carbon monoxide alarms to be installed in dwelling units built or manufactured in the state after a specified date; requires the seller of any owner-occupied single-family residence to equip the resident with carbon monoxide alarms before the buyer or any other person may legally occupy the residence; allows the building code council to exempt categories of residential buildings if it determines that requiring carbon monoxide alarms are unnecessary to protect the welfare of the occupants. Effective date: July 26, 2009.

Requires a manufacturer of a motor vehicle equipped with one or more recording devices to disclose in the owner's manual that the vehicle is equipped with such device; requires disclosure of the type of data recorded and whether the device has the ability to transmit information to another device; prohibits unlawful disclosure of information recorded by such devices; requires that manufacturer's make commercially available tools to access information on such devices. Effective date: July 26, 2009

Requires that a certified abstract of a driving record be furnished to an employer or prospective employer or volunteer organization, or an agent acting on behalf of an employer or prospective employer or volunteer organization, for employment purposes related to driving by an individual as a condition of that individual's employment; provides for the release of a driver's abstract to the individual named in the abstract. Effective date: July 26, 2009.
