Building Codes

Changes the title of the building energy efficiency standard act to the energy standard act; adopts the international energy conservation code as the energy standard; provides that all new and renovated buildings must comply with this standard; provides that local building officials shall enforce the energy standard; provides for alternative enforcers in areas without a building official; relates to injunctive relief, free access to building code documents and building permits for three story homes. Effective date: July 1, 2009.

Producer Licensing

Relates insurance; adds the definitions of general appointment, local appointment, special appointment, crop insurance and travel insurance; relates to premium service companies; amends fees for licensure to engage in servicing insurance premiums in this state; relates to the prohibition on splitting commissions with an unlicensed person by an insurance producer. Effective date: June 22, 2009.

Building Codes

Relates to building codes enforcement officers; establishes a special inspector to perform building inspections in one or more construction trade disciplines; provides the licensing procedure to require authorization for performing these inspections from the South Carolina Building Codes Council and the Department of Labor, Licensing and Regulation. Effective date: May 20, 2009.

Financial Regulation

Requiring insurers to file a statement of actuarial opinion annually; provides for document confidentiality; relates to the revocation or suspension of license of an insurer and officers; provides for a hearing and recourse through judicial review; relates to a company action level event; relating to approval for acquisition of a domestic insurer by controlling producer in another state; deletes applicability to foreign producers; relates to the total adjusted capital of a property and casualty insurer. Effective date: June 2, 2009.

Captive Insurers

Relates to licensing of a captive insurance company; prohibits such company to write workers' compensation insurance on a direct basis; authorizes an additional processing fee for an application; relates to capitalization requirements, discounts, reduction in required trust funds, reincorporation of a captive reinsurance company, reports, loss adjustment reserves, inspections, fines, prohibited participation in a plan, pool, guaranty or insolvency fund and authorized pool risk sharing. Effective date: June 2, 2009.

Arson Reporting

Relates to the arson reporting immunity act; adds certain public safety officials to the list of agencies authorized to receive information from an insurance company; relates to the Fire Chief, Sheriff or Chief of Police having jurisdiction over the arson investigation. Effective date: June 2, 2009.
