Fire Protection Systems

Relates to the licensing of persons installing fire protection systems; provides for apprentice sprinkler fitter and maintenance worker licensing; relates to evidence of a public liability insurance policy and surety bond; provides for provisional licensure. Effective date: July 1, 2009.

Boiler Issues

Relates to boiler and pressure vessel inspections and the Boiler and Pressure Vessel Board that oversees the inspections; provides that owners of boilers or pressure vessels who meet certain requirements shall conform to certain inspection requirements; provides for the membership and duties of the board. Effective date: July 1, 2009.

State Regulation

Relates to various matters under the purview of the insurance division of the Department of Commerce; includes the uniform securities act, the insurance division, articles of incorporation filing requirements, viatical settlements contracts, life insurance companies and associations, long-term care insurance, long-term care asset disregard incentives, insurance other than life, insurance guaranty associations, mutual insurance associations, mergers, reinsurance and funeral services. Effective date: Varies.

Requires counties and cities with flood hazard areas within their boundaries to participate in the national flood insurance program; requires preparation of a flood insurance report by the commissioner of insurance. Effective date: July 1, 2009.

Motor Vehicle Records

Restricts the resale and use of motor vehicle operating records furnished by the Department of Transportation to insurers; provides for any subsequent use, sale, disclosure, or distribution of the same certified abstract; provides for use by insurers and insurance producers to provide copies to consumers, for internal audits, internal purposes consistent with the federal Driver's Privacy Protection Act and to show compliance with retention requirements; relates to an insurance affiliate. Effective date: July 1, 2009.

Liquor Liability

Relates to the use of insurance loss history in the issuance of dramshop liability insurance; relates to underage persons; provides that if an insurer provides dramshop liability insurance at a new location to a licensee or permittee who has a positive loss experience at other locations, and the insurer bases premium rates at the new location on the negative loss history of the previous licensee or permittee at that location, the insurer shall consider adjusting the premium for the new location. Effective date: July 1, 2009.
