Changes provisions relating to points and fines for speeding violations. Effective date: July 18, 2008.

LB 624

Traffic Offenses

Changes provisions relating to operating a motor vehicle to avoid arrest; provides that any person who operates any motor vehicle to flee in an effort to avoid arrest and citation commits the offense of operation of a motor vehicle to avoid arrest and is guilty of a misdemeanor; provides that the court may revoke the operators license; provides for an enhanced penalty if certain conditions are met. Effective date: July 18, 2008.

Relates to driving under the influence; provides for a permit for the operation of a motor vehicle equipped with an ignition interlock device; changes penalty provisions; changes provisions relating to the use of ignition interlock devices; provides fees; creates the Ignition Interlock Device Fund to be used for the costs of installing, maintaining, and removing such devices for an indigent defendant. Effective date: January 1, 2009.

Relates to motor vehicles; changes provisions relating to motor vehicle certificates of title, registration, operators' licenses, rules of the road, and motor carriers; adopts the most recent International Registration Plan; defines and redefines terms; updates certain federal references; declares an emergency; relates to occupant protection systems, motor carriers, vehicle weight limits, dealer assignment forms, motorboats and idle reduction technology. Effective date: Varies.

Deceptive Trade Practices

Adds to the list of deceptive trade practices the use of any scheme or device to defraud by means of obtaining money or property by knowingly false or fraudulent pretenses, offering an unsolicited check to promote goods or services if cashing or depositing the check obligates the endorser or payee to pay for goods or services, or sending an unsolicited billing statement, invoice, or other document that appears to obligate the consumer to make a payment for services or merchandise he or she did not order. Effective date: July 18, 2008.

Taxes

Changes corporate income tax calculations; includes corporate taxpayers subject to tax in another state and insurance companies. Effective date: Retroactive to January 1, 2008.

LB 1055

Dangerous Dogs

Defines the terms mutilation, repeated beating, and torture as those terms relate to cruel treatment of animals; provides certain criminal penalties for convictions of cruelty towards animals, including a court order prohibiting ownership and possession of another animal; provides certain rules and procedures regarding dangerous dogs including, owner liability, sterilization, seizure, permanent assignment of the dog to a court-approved animal shelter or destruction of the dog in an quick, humane manner. Effective date: April 22, 2008.

Policy Provisions

Changes provisions relating to coverage changes in property and casualty and automobile liability policies; provides if an insurer reduces or eliminates any coverage or introduces a more restrictive condition as part of a policy in force delivered prior to renewal of the policy, the insurer shall send to the named insured a notice explaining clearly the changes in the policy. Effective date: July 18, 2008.
