Catastrophe-related Legislation

Relates to homestead exemption; extends the period of time during which dwelling houses located in the counties of the State covered by the Presidential Declaration of Major Disaster that were damaged or destroyed as a result of Hurricane Katrina so that the family group is compelled to temporarily reside in another place shall continue to be a home under the homestead exemption law. Effective date: January 1, 2009.

Traffic Safety

Requires persons transporting a child in a passenger motor vehicle to provide protection for the child by properly using a belt positioning booster seat system if the child meets certain age, height, and weight criteria; provides an exception when a vehicle is transporting more that a specified number of children who are required to use a booster seat; reduces the minimum age of a child who must wear a safety belt if the child is not required to use a booster seat. Effective date: July 1, 2008.

Workers’ Compensation

Relates appropriations; transfers funds in fiscal year to State Department of Audit; transfers funds to the State Development Authority from general expense of the Department to funding Tourism and Welcome Centers; directs the State Fiscal Officer to transfer a sum from the Workers' Compensation Commission Administrative Expense Fund to the Bureau of Building, Grounds and Real Property Management Fund for expenses related to usage of Worker's Compensation Commission Office Building. Effective date: April 3, 2008.

State Regulation

Authorizes the Commissioner of Insurance to establish bonding and insurance requirements for the licensure of manufacturers, modular contractors, developers, retailers and transporters or installers of factory built homes. Effective date: July 1, 2008.

Building Codes

Relates to building codes; provides that any county of municipality that adopts building codes shall adopt as minimum codes any codes established by the State Building Codes Council; increases the amount of insurance premium tax deposited with the Municipal Fire Protection Fund and allows funds to be used for training necessary for compliance with Codes adopted by the Council. Effective date: July 1, 2008.

Building Codes

Relates to building codes; provides that if any county of municipality adopts or has adopted construction codes which do not have proper provisions to maintain up to date amendments, specifications in such codes for cements used in portland cement concrete shall be superseded by nationally recognized specifications referenced in codes adopted by the State Building Council. Effective date: March 31, 2008.

Tax Issue

Changes the date by which insurance companies must file with the State Tax Commission a report of its gross premiums for the period provided and pay the insurance premium tax due. Effective date: July 1, 2008.

Workers’ Compensation

Relates to state employee; revises workers' compensation benefits when major medical leave is used; provides that when an employee's absence is due to a work-related injury for which the employee is receiving temporary disability benefits the injured employee shall not use accrued personal and/or medical leave and receive workers' compensation benefits simultaneously if the combined receipt of both benefits results in the employee being paid a total amount that exceeds one hundred percent. Effective date: July 1, 2008.

Fees

Increases certain fees for various services provided by the Commissioner of Insurance, including filing and processing an agent's certificate of authority and for continuing education courses or programs filed by the providers for approval; increases the fees collected by the Commissioner on fraternal orders doing an insurance business and for publication of annual statements. Effective date: April 7, 2008.

State Regulation

Relates to foreign insurance companies; authorizes the Commissioner of Insurance to contract with a third party to assist him in carrying out his duties in the regulation of foreign insurance companies; provides the third party may collect an examination fee in amount determined by the Commissioner who will be paid through the Department of Insurance Special Fund. Effective date: May 12, 2008.

Credit Property Insurance

Creates the classification of credit property insurance whereby insurance companies may be formed for insurance against loss of or damage to personal property purchased through a credit transaction or used as collateral for a credit transaction. Effective date: July 1, 2008.

Auto Liability Insurance

Relates to motor Vehicle Safety Responsibility Act; increases the percentage amount of funds that are deposited with municipalities when certain fines are levied upon failing to have motor vehicle liability insurance. Effective date: July 1, 2008.
