Ignition Interlock Devices

Relates to ignition interlock devices; limits driver's license privileges; relates to the crime of avoidance of ignition interlock device when a person knowingly circumvents or tampers with the device or rents a motor vehicle to a person who has an ignition interlock limited license; provides for court procedure for sentencing relating to convictions of driving under the influence of an alcoholic beverage, inhalant or controlled substance. Effective date: January 1, 2009.

Security Breaches

Relates to breaches of security involving personal information, credit report and credit score security freezes, consumer credit monitoring, credit accuracy, protection of social security numbers, care of records, disposal of records, identity theft, furnishing consumer credit header information, credit cards, and debit cards, and to the jurisdiction of the office of administrative hearings; amends Rule 60, Alaska Rules of Civil Procedure. Effective date: July 1, 2009.

Auto Equipment Issues

Provides that a person commits the crime of driving with a screen device operating if the vehicle being driven has a television, video monitor, portable computer, or similar device that is providing a visual display that is in full view of the driver in a normal driving position while the vehicle is in motion; provides specified exemptions, including portable cellular telephones, personal data assistants and navigation or global positioning devices. Effective date: September 1, 2008.

Workers’ Compensation

Relates to release of information in individual workers' compensation records; provides that the employees' name, address, social security number, electronic mail address, and telephone number contained on any such record is not public information. Effective date: September 2, 2008.

Construction Contracts

Requires an indemnification, defense and hold harmless provision in construction-related professional services contracts of state agencies, quasi-public agencies, municipalities, and political subdivisions. Effective date: May 26, 2008.

Workers’ Compensation

Relates to the presumption of coverage for a workers' compensation claim for disability as a result of certain diseases for certain fire fighters; provides there is a presumption that a claim for compensation for disability as a result of respiratory or cardiovascular disease, or certain cancers; provides a fire fighter may be eligible if he was given a qualifying medical examination upon becoming employed or was given an annual medical exam during employment and did not show evidence of the disease. Effective date: August 19, 2008.

Provides that a person commits the crime of arson in the third degree if the person intentionally damages a motor vehicle by starting a fire or causing an explosion while that vehicle is located on state or municipal land. Effective date:

Workers’ Compensation

Relates to certification of search and rescue personnel and organizations; requires certain search and rescue personnel to be considered state employees for purposes of workers' compensation coverage; allows municipalities to elect to provide workers' compensation insurance coverage for search and rescue personnel; relates to training of personnel and organizations. Effective date: September 14, 2008.
