Guaranty Funds

Increases the maximum potential assessment by the Alabama Insurance Guaranty Association for workers ‘ compensation insolvency to two percent of an insurer's net direct written premiums in workers' compensation insurance sold in this state for the calendar year preceding the assessment. Dangerous Dogs

Proposes a Constitutional amendment; relates to Mobile County, to allow the Legislature, by local law, to establish a procedure by which a dog can be declared dangerous and be humanely destroyed and to impose criminal penalties on the owners of a dog declared to be dangerous. Effective date: April 1, 2008.

Dangerous Dogs

Relates to Mobile County; establishes a procedure by which a dog can be declared dangerous or a nuisance and be humanely destroyed in the unincorporated areas of Mobile County; provides that a dog found to be dangerous, but which has not caused serious physical injury to a person, or a dog found to be a nuisance could be returned to the owner if certain registration requirements are met and the dog is securely enclosed. Effective date: April 1, 2008.

Captive Insurers

Relates to captive insurance companies being prohibited from providing personal motor vehicle or homeowner's insurance coverage or any component thereof, to remove that prohibition. Effective date: August 1, 2008.

Auto Financial Responsibility

Relates to the Motor Vehicle Safety-Responsibility Act; provides for certain insurance or financial responsibility on recovery for death, bodily injury, and loss of services and property; raises the limits required for liability under insurance coverage of personal fiscal responsibility because of bodily injury or death; increases the limit for property loss. Effective date: Varies.

Commercial Auto

Relates to commercial motor vehicles and providing that certain federal motor carrier regulations are applicable to commercial motor vehicles operating in the state; deletes certain exemptions operated in intrastate commerce under certain conditions; provides for an exemption for commercial motor vehicles having a gross vehicle weight or combination weight of 26,000 pounds or less operated in intrastate commerce. Effective date: May 13, 2008.
