Tort reform -- miscellaneous

Provides a properly processed order of restitution shall constitute a lien of any real property; revises provisions governing a victim's interest in speedy prosecution; requires a report by the restitution unit on a proposed revised restitution order after the investigation of any insurance or other payments made to the victim and a report the offender's payment history to credit reporting agencies; relates to access to financial records of the offender by the unit; relates to unclaimed property. Effective: varies.

Motor vehicle insurance - enforcement issues

Provides that the new motor vehicle arbitration board be attached to the department of motor vehicles; permits an offset to any refunds owed against amounts owed the department for dishonored checks; expands the list of documents presented to the department of motor vehicles which must be signed under oath; amends the law regarding false statements on applications; allows an enforcement officer to seize a snowmobile or all-terrain vehicle; prohibits fraudulent registration or identification cards. Effective: July 1, 2007.

Motor vehicle insurance -- traffic offenses

Clarifies when a suspension or revocation of a motor vehicle license, non-driver identification card, or registration takes effect; repeals the requirement that special plates or parking placards for persons with disabilities be renewed when the condition is permanent and stable; authorizes safety or service organization registration plates to be issued to trucks registered for a specified weight. Effective: July 1, 2007.

Motor vehicle insurance - towing issues

Clarifies existing law regarding wreckers and registration; allows wreckers to tow unregistered vehicles on public highways. Effective: July 1, 2007.

Motor vehicle insurance -- miscellaneous

Provides when the property transfer tax payment has been made and the required information is provided to the Tax Commissioner upon the transfer of a residence, the Commissioner shall pay the property tax adjustment to the transferor; relates to the statute of limitations on small claims judgment executions; provides that a motor vehicle and title shall revert to any surviving spouse upon the death of the owner when the will or other testamentary document does not address the vehicle's disposition. Effective: varies.

Relates to background check for Banking Division examiners; relates to credit for reinsurance on an insurers annual statement, using qualified accountants on insurer audits, insurance company pensions, suspension or revocation of a captive insurance licenses, and surplus lines insurers; relates to captive insurers and delinquencies, premium taxes, and licensing authority; relates to notice of filing for federal covered securities, and securities broker-dealer registration. Effective: varies.

Workers' compensation - benefits, claims and authorized treatments

Adds new sections to existing law that governing workers' compensation to provide that in the case of a firefighter who suffers death or disability from a listed cancer, the firefighter shall be presumed to have suffered the cancer as a result of exposure to conditions in the line of duty under certain conditions, unless it can be proven by a preponderance of evidence, that the onset of such cancer was not employment related. Effective: July 1, 2007.

Workers' compensation - contractor requirements

Increases penalties for employer failure to comply with workers' compensation insurance requirements; provides for a workers compensation compliance statement to be submitted by a nonresidential construction contractor, subcontractor, or independent contractor; allows for the pursuit of administrative penalties in a superior court for false representations by an employer for the purpose of gaining a lower workers compensation premium. Effective: July 1, 2007.
