Identity theft – security breach

Relates to commerce; regulates access devices; establishes liability for security breaches; provides enforcement powers; defines access devices as a card issued by a financial institution that contains a magnetic stripe, microprocessor chip, or other means for storage of information which includes, but not limited to a credit, debit, or stored value card; relates to security breaches to pin numbers. Effective: August 1, 2007.

Aircraft liability

Increases the required minimum liability limits on aircraft insurance; provides that aircraft liability insurance is not voidable retroactively after a claim. Effective: varies.

Motor vehicle insurance – auto coverage issues

Regulates rental vehicle coverage; extends basic economic loss benefits, residual liability insurance, uninsured and underinsured motorist coverage to the operation or use of the rented motor vehicle; requires notification regarding additional insurance; provides for a policy of self-insurance when the operator is not covered by a plan of reparation security. Effective: August 1, 2007.

Contractor insurance coverage

Amends insurance requirements for building contractors; provides that each licensee shall maintain commercial general liability insurance, with specified limits for bodily injury and property damage; provides that the insurance shall not be canceled without the insurer first giving a written notice of cancellation to the commissioner. Effective: August 1, 2007.

Motor vehicle insurance – auto body shops

Requires motor vehicle collision repair to include air bag repair or a replacement; provides criminal penalties; relates to mandatory air bag replacement; prohibits installation or reinstallation of any object in lieu of an air bag designed for the make, mode and year of the vehicle. Effective: August 1, 2007.

Workers’ compensation – fund management

Requires the commissioner of labor and industry to provide information regarding federal exclusions from state workers' compensation coverage; requires a report; requires provision of information to medical care providers, employers, employees, insurers and others involved in the worker compensation coverage system. Effective: May 5, 2007.
