Promotes fairness for all residential condominium unit owners; requires that all residential condominium unit owners be treated fairly with respect to the property insurance on the condominium; relates to flood insurance for condominiums located in flood hazard areas; provides for repair in excess of available insurance proceeds, regardless of whether the excess is the result of an insurance deductible; provides for repair of common areas. Effective: October 1, 2007.

Motor vehicle insurance - traffic safety

Concerns wheelchair transfer safety; ensures the safety of wheelchair bound individuals who ride in invalid coaches; requires use of a device designed to secure such persons and requires such device to be located in the vehicle at all times; relates to service buses, vanpool vehicles, motor buses, student transportation vehicles and camp vehicles; includes vehicles used by municipal, volunteer and commercial ambulance services, rescue services and management services. Effective: October 1, 2007.

Workers' compensation - disputes and settlements

Concerns apportionment of liability in a negligence action, costs and attorney's fees in an action of foreclosure or upon a bond substituted for a mechanic's lien; permits a defendant in a negligence action to allege that another person, including a person who is immune from liability under worker's compensation law, was a substantial factor in causing the plaintiff's injuries or damages. Effective: October 1, 2007.

Provides for electronic-only filing of annual financial audits by a foreign insurer to be made instead of requiring hard copy; revises the health care definition to more accurately define the range and categories of health care services. Effective: October 1, 2007.

Catastrophe-related legislation

Establishes mitigating measures to mitigate catastrophic losses due to hurricanes and severe storms; relates to homeowners insurance policies; prohibits insurance companies from requiring the installation of hurricane shutters as a condition of insurance; requires a premium discount for homeowners who install storm shutters or impact-resistant glass; includes mobile home dwellers; provides for a Coastal Market Assistance program established by the Insurance Commissioner. Effective: October 1, 2007.

Requires automobile insurance discounts for drivers sixty years of age and over who complete an accident prevention course; enhances driver safety by encouraging individuals sixty years of age and older to take and pass an accident prevention course approved by the Commissioner of Motor Vehicles. Motor vehicle insurance - traffic offenses

Concerns notice of parking violations on a rented or leased motor vehicle; provides for service of a notice of parking violation on the operator of the motor vehicle who may be subject to nonrenewal of registration for nonpayment of fines for parking violations; provides that upon notification, the owner of a rented or leased vehicle may notify the municipality of he lessee at the time of issuance of the violation; provides for address, motor vehicle operator's license number and state of issuance. Effective: October 1, 2007.

Concerns medical malpractice claims against chiropractors; requires the Insurance Department to collect and make public information regarding medical malpractice claims against chiropractors; provides that a claim means a request for indemnification filed by a medical professional or hospital. Workers' compensation - benefits, claims and authorized treatments

Provides for notification to injured employees of the discontinuation or reduction of workers' compensation benefits; provides clear notice to a workers' compensation claimant of the intent to discontinue or reduce workers' compensation benefits to require certification by the attending physician of a worker's ability to return to work and to increase the period of time the worker has to request a hearing on such discontinuance or reduction; requires medical documentation. Effective: October 1, 2007.

Concerns notice in dram shop actions involving death or incapacity; restores former provisions concerning the computation of the required notice period for bringing a dram shop action in the case of the death or incapacity of an aggrieved person. Effective: October 1, 2007.

Relates to the workers' compensation medical practitioners' fee schedule; permits the Workers' Compensation Chairman to establish fees for workers' compensation medical providers using the Medicare resource-based relative value scale for establishing provider payments; provides that the conversion to the Medicare resource-based relative value scale shall be revenue-neutral; relates to adjustments to the fee schedules; provides for the filing of an appeal. Effective: October 1, 2007.

Relates to the tolling of the statute of limitations in wrongful death cases; clarifies the applicability of the automatic ninety-day extension of the statute of limitations to allow reasonable inquiry in personal injury and wrongful death civil actions; provides for recovery of damages from personal injury.
