Creates panels for medical injury claims. Establishes a committee to study medical malpractice insurance rates and the effectiveness of the mandatory panel process. (Study of Insurance Department) |
Establishes a committee to study the New Hampshire Department of Insurance to determine whether it should be combined with another state agency. Also calls for a study of the awarding of bids for health insurance for state employees. Omnibus Insurance Law Changes |
Makes certain technical changes to the insurance laws, including but not limited to: clarifying the law regarding insurance premium refunds; changing the time frame for when a producer must report any administrative action taken against the producer in another jurisdiction; revising the laws relating to forms and rate regulation applicable to workers' compensation; repealing the prospective repeal of the law allowing voluntary small employer health insurance purchasing alliances; and clarifying the managed care law relative to grievance procedures. (Cumulative Trauma) |
Establishes that for an injury caused by cumulative trauma, the date of injury is the date of first medical treatment; and for an injury or condition aggravated by cumulative trauma, the date of injury is the date of first medical treatment for the aggravation. (Omnibus Worker's Compensation Law Changes) |
Changes the amount insurance carriers and self-insurers pay to the special fund for second injuries; clarifies when a decision of the commissioner or the compensation appeals board becomes final; allows the commissioner to suspend a board member who fails to render a decision in a timely manner; and require first reports of injury to be filed electronically, unless it causes a carrier or self-insured employer undue hardship.
