Provides that a person may not be prohibited from exercising specified rights in delinquency proceedings brought under specified provisions of law against specified insurer. Further requires net or settlement amounts due to any insurer subject to a specified delinquency proceeding be transferred to or on the order of the receiver for the insurer; specifying the manner in which a receiver in a delinquency proceeding must transfer specified netting agreements and qualified financial contracts. Licensure |

Miscellaneous New Insurance Provisions |

(Federal Antitrust Exemption) |
Provides that specified provisions of law do not make illegal the activity of persons engaged in insurance with respect to conduct regulated by the insurance commissioner or authorized by specified provisions of law. Provides that specified provisions of the Act may not be construed to prevent the application of specified provisions of law to persons who agree to or engage in specified act and makes a specified stylistic change. (Cancellation Nonrenewal) |
Prohibits insurers, except under specified circumstances, from denying, refusing to renew, cancelling or rasing private passenger auto or homeowner rates for military personnel returning from active duty overseas because they fail to meet underwriting standards that require continuous coverag. Clarifies applicability of specified standards related to an insurer's economic and business purposes. LAW.Effective 10/1/05. Chapter 424, Laws of 2005. |

Motor Vehicle Insurance |

(Miscellaneous New Motor Vehicle Insurance Provisions - Attorney Fees) |
Requires insures who alter specified information under a motor vehicle liability policy must include such alteration information in a notice to the insured and clarifies circumstances where the insurance commissioner shall order an insurer to pay reasonable attorney fees to the insured after a specified hearing. (Traffic Safety - Graduated Driver's License) |
Prohibits (minor) provisional licensees from transporting passengers under age 18 except under specified circumstances and requires the prohibition to be in effect for a specified period of time. Exempts specified passengers from the provisions of the Act, provides for secondary enforcement of a violation as a moving violation. LAW. Effective 10/1/05. Chapter 542, Laws of 2005. |

(Traffic Safety - Graduated Driver's License) |
Requires learner's permit holders to complete at least 60 hours of driving practice with a license holder at least 21 years of age and licensed for at least 3 years and requires at least 10 of those practice hours to occur at night. Requires a practice driving skills log to be signed by an individual certifying that the practice driving requirements of the Act have been fulfilled. LAW. Effective 10/1/05. Prohibits learner's permit holders or provisional licensees from using specified types of wireless communication devices while operating motor vehicles. Prohibits learner's permit holders or provisional licensees from using a specified wireless communication device while operating a motor vehicle, provides specified exceptions and authorizes the Motor Vehicle Administration to issue a specified restricted license. Prohibits a provisional driver's licensee from receiving a driver's license sooner than 18 months following the later of the date the individual first obtains the provisional license, the date the individual has been convicted of specified violations, or the date of restoration of the individual's provisional license or driving privilege. Rate Regulation |
