SB 650

Miscellaneous New Insurance Provisions

(Agent Appointment)

HB 6807

Waives the filing fee for any insurer that requests an agent appointment in this state when the insurer is domiciled in a state or foreign country that offers reciprocal waivers to Connecticut insurers. LAW. Effective 10/1/05. Public Act 05-25, Laws of 2005.

(State Budget Provisions)

HB 7502

Section 59 sets forth notification requirements applicable to insurers for death or bodily injury claims. LAW. Effective upon passage. Public Act 05-3, Laws of 2005.

(Cancellation or Nonrenewal - Personal Risk Coverage)

SB 31

Limits the ability of insurers to cancel or refuse to renew homeowners, tenant and automobile insurance policies for failure to pay late fees so long as the premium or required installment payment is paid when due. Requires each insurer that assess a fee for late payment of premium on a policy for personal risk insurance must indicate the amount and applicability of the fee in a conspicuous manner on the actual bill sent to the policyholder. Assigned Public Act # 05-162.

(Civil Unions)

SB 963

Authorizes same sex marriages. LAW. Effective 10/1/05. Public Act 05-10.

(Omnibus Insurance Law Changes)

SB 999

Amends the insurance statutes to authorize the insurance commissioner to adopt regulations concerning the confidentiality of certain documents, add "affiliates" to provisions concerning the investment of admitted assets, delete a reference to the licensing fee section under the Unfair Insurance Practices Act, and amend the definition of "insolvent insurer" under the Connecticut Insurance Guaranty Association Act. Public Act #05-140. Sent to Secretary of State 6/8/05.

(Owner Controlled Insurance Programs)

SB 1251

Outlines procedures concerning owner controlled insurance programs on state and municipal construction projects. Assigned Public Act # 05-193. Sent to Secretary of State 6/20/05.

Motor Vehicle Insurance

(Traffic Safety - Cell Phone Restriction)

HB 6722

Establishes prohibitions on the use of cellular phones while operating motor vehicles. LAW. Effective 10/1/05. Public Act 05-159.

(Traffic Safety - GDL)

HB 5446

Expands the means of acceptable training, increases the hours of required behind the wheel training and restricts nighttime driving privileges for drivers under the age of 18. LAW. Effective 10/1/05. Public Act 05-54.

Producer Compensation

HB 6806

Requires certain insurance producers to disclose their compensation arrangements to consumers prior to the delivery of a new insurance contract. LAW. Effective 10/1/05. Public Act 05-61, Laws of 2005.

Tort Reform

(Good Samaritan Law)

HB 6286

Broadens the scope of immunity from liability for negligence for the emergency use of cartridge injectors under the Good Samaritan law and to require before or after school programs, day camps and day care facilities to provide staff trained in the use of cartridge injectors. LAW. Effective 10/1/05. Public Act 05-144.

(Medical Malpractice)

SB 1052

makes numerous changes in the laws dealing with medical malpractice-related civil litigation impacting contingency fees, requisites to filing medical malpractice actions, offer of judgment, interest on offer of compromise and noneconomic damage claims, among other things. LAW. Effective upon passage. Public Act 05-275.

(Ski Operators)

SB 256

To provide that ski area operators shall be liable for injuries occurring on their premises for which they are the sole proximate cause. LAW. Effective 10/1/05. Public Act 05-78, Laws of 2005.

(Small Claims Actions)

SB 1121

Increases the maximum amount of money damages in a small claims action from three thousand five hundred dollars to five thousand dollars. LAW. Effective 10/1/05. Public Act 05-42.

(Third-Party Liability)

SB 795

Protects a purchaser of land, under certain conditions, from liability to persons other than this state, any other state or the federal government for pollution on such land that existed or occurred prior to purchase. LAW. Effective 10/1/05. Public Act 05-90. Laws of 2005.

Uniform Commercial Code

HB 6985

Adopts revisions to article 1 of the Uniform Commercial Code concerning general provisions in order to conform Connecticut commercial law with recent changes in the uniform law. LAW. Effective 10/1/05. Public Act 05-109, Laws of 2005.

Workers' Compensation

(Second Injury Fund)

SB 1336

Changes in the laws governing the Second Injury Fund, a state-run workers' compensation fund that the state treasurer administers. It exempts the fund from liability in certain cases and reduces the fund's potential liability by prohibiting retroactive claims older than two years from the date on which the employer or its insurer paid benefits. Assigned Public Act # 05-199.
