Motor vehicle insurance - UM/UIM

Clarifies that a motor vehicle is underinsured to the extent that its personal injury liability insurance is unavailable to any injured party due to claims made by other parties injured in an accident; clarifies that a person is not required to have a court judgment in order to receive policy information from the insurers of other persons involved in an accident. Effective: May 27, 2006.

Motor vehicle insurance - traffic offenses

Relates to a suspended license; voids the vehicle registration of a person operating a vehicle with a suspended license or without sufficient automobile insurance, and authorizes seizure of the vehicle registration plate from the person; provides that any deaf or hard of hearing person who is a party or witness in any proceeding shall be entitled to be provided with a qualified interpreter for the duration of the person's participation in the proceeding; prohibits disturbing a funeral service. Effective: Varies.

Fraud

Establishes the offense of insurance fraud and prescribes penalties and establishes requirements for insurers to file anti-fraud plans with the commissioner of banking, insurance, securities, and health care administration and to include fraud statements on certain documents. Effective: July 1, 2006.

Motor vehicle insurance - auto equipment issues

Sets forth conditions for, and specifications of, installing after-market material on the front side windows of a motor vehicle; provides for an exemption for medical reasons given by a licensed physician or optometrist. Effective: July 1, 2006.

Workers' compensation - benefits, claims or treatments

Includes volunteer firefighters in the presumption that disability or death suffered from heart injury or heart disease that becomes symptomatic within 72 hours of service in the line of duty shall be compensable. Effective: July 1, 2006.

Identity theft - security freeze

Allows any consumer to place a security freeze on his or her credit report; provides that there would be no charge for victims of identity theft and consumers over 64 years of age. Effective: July 1, 2006.

Identity theft - personal information

Requires any data collector of personal information to disclose to an individual if there was an unauthorized acquisition or access to the individual's personal information that the collector owns or is using; provides that notice would not be required if the data collector establishes that the misuse of the personal information is not reasonably possible, and the data collector notifies the attorney general or the department of banking, insurance, securities, and health care administration. Effective: Jan. 1, 2007.
