Indiana Senator Bayh Announces Retirement

Yesterday, Indiana Senator Even Bayh announced in Indianapolis that he would not be seeking a third term and would instead be retiring at the end of the year. (Posted: 2/16/2010)


Indiana: Supreme Court Addressed Tort Claim Immunity, Temporary Weather Conditions

Indiana’s Tort Claims Act provides immunity to governmental units from liability for losses caused by temporary weather conditions. The Indiana Supreme Court has previously held that such immunity is applicable during the period of reasonable response to weather conditions. In a case decided by the Supreme Court on Jan. 27, the Supreme Court held that the period of immunity lasts at least until the weather condition has stabilized and immunizes the governmental entity from liability for alleged flaws in its remedial actions. Indiana: Notice of UIM Claim Adequate for UM Notice Compliance

In a case decided Oct. 30, the Indiana Supreme Court held that notice to a motorist’s insurer of a possible underinsured motorist claim was adequate for compliance with the policy requirement that notice of an uninsured claim be made within two years. (Posted: 1/12/2010)


Indiana: No CGL Coverage for Alarm Company’s Failure to Observe

In a much-litigated case that arose from events occurring nearly 12 years ago, the Indiana Supreme Court has ruled that there is no insurance coverage under an alarm company’s commercial general liability and umbrella policies for the company’s delay in observing or reacting to the failure of a retailer’s scheduled setting of a night alarm. Tri-Etch, Inc., et al. v. Cincinnati Insurance Company was handed down on July 21 in a unanimous opinion. (Posted: 7/28/2009)

Indiana Members in Washington for 2009 CCP

NAMIC member companies from Indiana were in Washington, D.C., last Tuesday to participate in the 2009 Congressional Contact Program. The group had successful meetings with every office in its state delegation and handed out four Benjamin Franklin Public Policy awards. This was Indiana's 22nd year participating in CCP. Indiana: Governor Appoints Atterholt to IURC, Cutter to Lead Department of Insurance

Gov. Mitch Daniels announced June 16 the appointment of Department of Insurance Commissioner Jim Atterholt to the Indiana Utility Regulatory Commission to fill the vacancy left by the resignation of Greg Server. Current DOI Chief Deputy Commissioner Carol Cutter, a Bedford native, will succeed Atterholt. (Posted: 6/16/2009)


Indiana: Supreme Court Upholds Restriction on UM Coverage

In a case in which NAMIC participated along with the Insurance Institute of Indiana as amici curiae, the Indiana Supreme Court has ruled that a restriction in coverage in the underinsured motorist provision of a State Farm policy does not violate the state’s UM law. (Posted: 5/19/2009)


Indiana: No Duty to Defend Environmental Claim in Absence of Knowledge of the Claim

In an environmental damage claim, an insured waited more than three years to notify its insurer of the claim and to seek reimbursement for defense costs and expenses incurred during the pre-notice period. The Indiana Supreme Court held on April 28 that the insurer’s duty to defend did not arise as to the pre-notice costs and that prejudice was an irrelevant consideration. (Posted: 5/19/2009)
