Illinois: Repeal of Medical Malpractice Caps to Increase Physician Liability Claim Costs 18 Percent
Milliman, Inc., a global consulting and actuarial firm, released results on Feb. 22 from a study of physician professional liability in the State of Illinois. A Feb. 4 decision by the Illinois Supreme Court overturned caps on non-economic damages awarded to claimants. This change in the tort law is likely to have financial implications for insurers in Illinois. Indemnity claim severities will increase by approximately 23 percent and the average cost that insurers expend defending claims will increase by 10 percent, relative to what these costs would have been had the cap held. The average overall increase in claim severity will be approximately 18 percent. (Posted: 2/22/2010)

Illinois: Workers’ Comp Benefits Continue After Termination
The Supreme Court of Illinois issued an opinion on Jan. 22 holding that when an employee who is entitled to workers’ compensation benefits is later terminated for conduct unrelated to the injury, the obligation to pay temporary total disability benefits continues until the medical condition is stabilized and the employee has reached maximum medical improvement. Illinois: Supreme Court Throws Out Medical Malpractice Reforms
This week, in a 4-2 vote, with one justice not participating, the Illinois Supreme Court ruled that the cap on non-economic damages adopted by lawmakers in 2005 in response to the medical malpractice crisis was unconstitutional because it violated the separation of powers clause in the state constitution. Illinois Members in Washington for 2009 CCP

Illinois Supreme Court Rules in Asbestos Case
The Illinois Supreme Court issued a long-awaited decision April 16 in Nolan v Weil-McLain, No. 103137, 365 Ill App 3rd 963. In its opinion, the court changed direction and overturned the so-called “Lipke rule” from a prior Illinois appellate decision handed down in 1987. Under the Lipke rule, juries in asbestos cases were kept in the dark about central facts related to causation. Jurors would hear only of exposure to the defendant’s asbestos-containing products made or sold by other responsible parties that had settled, were insolvent or were otherwise unavailable for trial. Car Cloning Criminal Network Taken Down in Tampa, Miami, Chicago, and Mexico
A car cloning scheme joint investigation, Operation Dual Identity, identified criminal cells in Tampa, Fla., Miami, Chicago, and Mexico. This joint investigative effort is one of the largest auto theft cases in the United States. (Posted: 3/25/2009)
For the second year in a row the vehicles most likely to collide with a deer are in West Virginia. Using its deer claims data from the last half of 2007 and the first half of 2008 and motor vehicle registration counts by state from the Federal Highway Administration, State Farm estimates the chances of a West Virginia vehicle colliding with a deer during the next 12 months at 1 in 45.
