“HB 1364 is an attempt to address a tragic situation, but it does so in violation of core principles of insurance. Requiring retroactive payment of claims by the Georgia Insurers Insolvency Pool for captive workers’ compensation insurers at ‘buy in’ amounts bearing no relationship to the true cost of the risk is like requiring an insurance company to pay a claim on a vehicle that was wrecked the day before coverage was purchased. Georgia: NAMIC Requests Member Companies to Contact Governor Asking for Veto of Insolvency Pool Bill

NAMIC sent a letter to Gov. Sonny Perdue on Thursday requesting that he veto HB 1364, Georgia Insurers Insolvency Pool, which allows insureds of insolvent captive workers’ compensation companies to benefit from the insolvency pool. The final agreement passed prior to the end of the session Thursday night, and the bill is now on the governor’s desk. (Posted: 5/4/2010)


Georgia Insolvency Pool Bill Likely to Pass; Letters to Governor Requesting Veto Needed Now

HB 1364, Georgia Insolvency Pool legislation, last week was amended in the Senate and sent back to the House for an “agree” or “disagree” vote. NAMIC members doing business in Georgia were alerted to this development and asked to urge House members to vote to “disagree,” which would send the bill to a conference committee.
