Louisiana: Katrina/Rita Anniversary, Oil Spill Discussions Feature Insurance

Insurance was the focus of a summit convened last week by Louisiana Commissioner Jim Donelon to take stock of the “recovery, reform, and results” since Hurricanes Katrina and Rita five years ago. Connecticut: High Court Agrees With NAMIC, Rules AG Limited in Ability to Share Confidential Data

The Connecticut attorney general is not free to share confidential information submitted during an antitrust investigation to anyone without restriction in furtherance of antitrust investigations, the Connecticut Supreme Court ruled, in agreement with the position taken by NAMIC in an amicus brief filed with the court. Massachusetts: Attorney General Extends Comment Period for Proposed Auto Insurance Regulations

Massachusetts Attorney General Martha Coakley has extended the period for public comment on proposed auto insurance regulations opposed by NAMIC and most insurers from Aug. 6 to Sept. 22. (Posted: 8/17/2010)


Michigan: State Supreme Court Creates New Tort Standard

The highest court in Michigan released on Sunday its decision on McCormick v Carrier. Although the industry is still sifting through the 113-page opinion, it is clear that the thrust of the decision is to overturn 2004’s Kreiner v Fischer and establish a new threshold for tort recovery in the state. New York: Department Issues New Reinsurance Collateral Reduction Outreach Draft

The New York Insurance Department has posted on its website a new draft regulatory proposal that would allow for the reduction or elimination of collateral posting requirements for alien and unauthorized reinsurers. (Posted: 8/3/2010)


Massachusetts: Amount Billed for Medical Expenses is Admissible, But Amount Paid is Not, High Court Rules

Siding with the trial bar and disagreeing with the position of an amicus brief filed by NAMIC, the Massachusetts Supreme Judicial Court recently ruled that, pursuant to a state statute, medical bills may be introduced as evidence in personal injury cases, but the amount paid and accepted as full payment by the medical provider cannot be disclosed to the jury.
