In this opinion decided May 23, 2013 the Supreme Court of Illinois ruled that damages awarded pursuant to the Telephone Consumer Privacy Act of 1991 are remedial in nature rather than punitive and therefore did not address the issue of insurability of punitive damages that was the focus of an amicus brief filed by NAMIC.
