On Oct. 5 the Kansas Supreme Court in the case of Miller v. Johnson (No. 99818) ruled that the state's non-economic damages cap of $250,000 (which applies to all tort actions) is constitutional. The vote was 5 to 2 and the opinion and dissents totaled 109 pages.
