The Louisiana Department of Insurance issued Sept. 10 an amended version of Emergency Rule 26. Two key amendments to the section 4701(B) to Emergency Rule 26 include:
The provisions of Emergency Rule 26 are now limited to those policyholders residing in the following counties: Ascension, Assumption, East Baton Rouge, East Feliciana, Iberville, Jefferson, Lafourche, Livingston, Orleans, Plaquemines, Pointe Coupee, St. Bernard, St. Charles, St. Helena, St. James, St. John, St. Mary, St. Tammany, Tangipahoa, Terrebone, Washington, West Baton Rouge and West Feliciana.
The amended version also stipulates that the insured must provide written notice to the insurance company as to reason for displacement by Sept. 25, 2012.
These amendments provide insurers clearer guidance as to how to apply the provisions in Emergency Rule 26.
