Minnesota: Procedures Issued for Trade Secret Information in SERFF Filings

The Minnesota Department of Commerce has issued Bulletin 2008-02, setting out procedures to be followed by insurers if their filings made through the System for Electronic Rate and Form Filing include trade secrets.

Under Minnesota law, all government data collected and maintained by the Department of Commerce is accessible to the public. However, an entity can prevent public access to certain data in its SERFF filings if the data meets the requirements for “trade secret information.”

The Bulletin, issued on Feb. 15, sets out the specific procedures that are to be followed to request maintenance of data in SERFF filings as trade secrets. The Bulletin also explains the review process that is available if the Department of Commerce determines that the data in question is not trade secret information.
