New York: Court of Appeals Allows Consequential Damages in Bad Faith Case

Despite the arguments of NAMIC and other insurance trade associations, the New York Court of Appeals ruled that, policy provisions to the contrary notwithstanding, a policyholder could recover consequential damages in a bad faith action against its insurer.
