Indiana: Second Injury Fund not Liable for Medical Expenses

In a case handed down on April 11, the Indiana Court of Appeals held in Cincinnati Insurance Company v. Secondary Injury Fund that while the state's workers' compensation Second Injury Fund may become liable for payment of an injured person's weekly compensation after 500 weeks, the applicable law does not require that the fund also become liable for the worker's medical expenses after 500 weeks.
