Alabama/Mississippi: Building Code Bills Signed into Law

Alabama Gov. Bob Riley and Mississippi Gov. Haley Barbour last week both signed into law building code legislation enacted earlier this month in their respective state legislatures.

Gov. Riley signed House Joint Resolution 653 that creates a 12-member commission to study and make recommendations on a possible statewide building code. The insurance industry will have one representative on the commission.

In Mississippi, Gov. Barbour signed House Bill 1406, a bill that requires five of the state's most southerly counties to adopt wind and flood mitigation requirements on an emergency basis within 30 days from the bill's signing.

However, within 60 days after the emergency provisions take effect, the board of supervisors of a county and/or the governing authorities of any municipality within a county, upon resolution duly adopted and entered upon its minutes, may choose not to be subject to the code requirements.
