Missouri Supreme Court Rules Malpractice Non-Economic Damages Caps Not Retroactive, Does Not Address Issue of Constitutionality of Caps
NAMIC’s state trade association partner, the Missouri Insurance Coalition, informs us that the Missouri Supreme Court issued its ruling in the case that had challenged the constitutionality of the cap on non-economic damages for medical malpractice cases. The cap was passed as part of the state’s 2005 tort reform.
