Disparate Impact Theory [F/S]
NAMIC opposes all efforts by policymakers at both the state and federal to impose the disparate impact standard onto the provision of homeowners insurance. Doing so could undermine the risk-based underwriting process, while triggering a wave of frivolous litigation, and would also violate the jurisdiction of the states to regulate insurance under the McCarran-Ferguson Act.
