Punctuating the new leadership environment in Tennessee is SB 777, allowing for a 15 percent variable flex-rating system, wherein an insurer may apply the rate the day it is filed with the Department of Insurance. The measure specifies that a filing made by an insurer for personal risk insurance that provides for an overall statewide rate increase or decrease of up to 15 percent in the aggregate for all coverages. The commissioner may issue a written order to desist the rate if it is found to be inadequate or unfairly discriminatory according to the new legislation.
