Illinois: Supreme Court Throws Out Medical Malpractice Reforms

This week, in a 4-2 vote, with one justice not participating, the Illinois Supreme Court ruled that the cap on non-economic damages adopted by lawmakers in 2005 in response to the medical malpractice crisis was unconstitutional because it violated the separation of powers clause in the state constitution.
