South Dakota Senate Reconsiders Bad Subrogation Bill and Passes It the Second Time

A wild legislative week in Pierre got even wilder when the South Dakota Senate reconsidered its earlier rejection of SB 169, which would adopt the “made whole” doctrine and undermine insurer subrogation programs. The sponsors were able to flip a no vote to yes and pass the bill, which now goes to the House of Representatives.
